Terms of Service

These Terms of Service (“Terms”) govern your use of the Reply AI voice receptionist and scheduling service (the “Service”), provided by Reply (operated by WickScout Finance LLC)(“Reply,” “we,” “us”). By creating an account or using the Service, you agree to these Terms.
1. The Service
Reply answers inbound phone calls on your behalf using artificial intelligence, captures caller and job details, checks availability, books appointments, and sends text and email confirmations. Features may change over time.
2. Accounts & eligibility
You must be at least 18 and able to form a binding contract. You are responsible for the accuracy of your account information and for all activity under your account, including keeping your credentials secure.
3. Your responsibilities & acceptable use
- You will use the Service only for lawful business purposes and will not use it to send spam, harassing, fraudulent, or illegal content.
- You represent that you have all necessary rights and consents to have Reply contact, record, and message your customers, and to comply with applicable laws including the Telephone Consumer Protection Act (TCPA), CAN-SPAM, and call-recording laws in the relevant jurisdictions.
- You are responsible for providing required disclosures and honoring opt-out (STOP) and help (HELP) requests from your customers.
4. Fees & billing
Paid plans are billed in advance on a recurring basis (e.g., a monthly subscription plus any one-time setup fee and per-call usage above included limits). Subscriptions renew automatically until cancelled. Fees are non-refundable except where required by law. We may change pricing on prospective notice.
5. Text messaging (SMS) program
Messages sent through the Service are transactional and relate to appointments and service (for example, appointment confirmations, reminders, and service updates). Recipients opt in by providing their mobile number to a business that uses Reply when they call or book. Message frequency varies based on your interactions. Message and data rates may apply. Reply HELP for help or STOP to opt out at any time; after STOP you will receive one confirmation and no further messages. Carriers are not liable for delayed or undelivered messages.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for how messaging data is collected, used, and handled.
6. Third-party services
The Service relies on third-party providers (for telephony, AI, hosting, payments, and more). Your use may be subject to their terms, and we are not responsible for their acts or omissions.
7. Intellectual property
Reply and its software, branding, and content are owned by us and our licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. You retain ownership of your own data.
8. Disclaimers
The Service uses automated AI and may make mistakes, mishear details, or be unavailable. It is provided “as is” and “as available” without warranties of any kind. We do not guarantee that every call will be answered or booked correctly. You are responsible for reviewing bookings and confirming critical details.
9. Limitation of liability
To the maximum extent permitted by law, Reply will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the three months before the event giving rise to the claim.
10. Indemnification
You agree to indemnify and hold Reply harmless from claims arising out of your use of the Service, your content, or your violation of these Terms or applicable law (including TCPA and recording-consent laws).
11. Termination
You may cancel at any time. We may suspend or terminate the Service for violation of these Terms or for non-payment. Upon termination, your right to use the Service ends.
12. Governing law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules.
13. Changes
We may update these Terms; continued use after changes means you accept them.
